Seasonly x The Bradery

 

Article 1 – Definition and conditions of the prize draw

The company SYMMETRICS, a simplified joint-stock company with its registered office at 25 rue du Mail, 75002 PARIS, registered under number 83944225800027 (hereinafter “the Organiser, the Organising Company, the Organisers, the Professional”) is organising a prize draw as part of a marketing operation

 

The company SEASONLY (hereinafter “the Organising Company”), a single-member simplified joint-stock company with share capital of €393,545, registered with the Toulouse Trade and Companies Register under number 817 577 786 R.C.S., with its registered office at 11 B RUE ANTONIN MERCIE, 31000 TOULOUSE, is organising, from 07/02/2023 to and including 14/02/2023, a competition including a €150 gift voucher to be used on The Bradery and a one-hour treatment at a Seasonly studio (worth 130).

 

The “Participants” in the prize draw are also referred to below as “the Participants, the Users, the Contributors, the Players”. The “Winners” of the prize draw are also referred to below as the “Winners”.

 

Article 2 – Conditions of participation

This competition is open to any adult natural person residing in mainland France, after accepting the participation conditions in accordance with the French Data Protection Act. Only one entry per natural person is accepted throughout the duration of the Competition. Persons working for the companies SYMMETRICS and SEASONLY, as well as members of their families, are excluded from participation in the competition. 

 

Article 3 – Competition dates from 5 to 12 February 2023 inclusive

Competition start date: 7 February 2023 at 18:30

Competition end date: 14 February 2023 at 12:00

Prize draw date: 14 February 2023

Date Winners are designated: 14 February 2023

 

Article 4 – Terms of participation

4.1) Application submission conditions

To register for the prize draw and attempt to win the prize offered in Article 5, each participant must have completed the actions mentioned below:

  • Subscribe to the www.wollnessbetter.shop newsletter and tick the box authorising the receipt of partner offers.

OR

  • Subscribe to the seasonly.fr newsletter and tick the box authorising the receipt of partner offers.

Registration for the prize draw is only effective once these steps have been completed.

Participation in the prize draw will only be valid if the information required by SYMMETRICS & SEASONLY is complete and correct. Any registrations made using incorrect or falsified information, or via counterfeit or falsified forms, will automatically forfeit any right to obtain any winning prize.

Each participant therefore undertakes to provide accurate information about themselves. SYMMETRICS & SESONLY disclaim all liability where a participant uses false surnames and/or first names associated with a valid email address or a false email address.

 4.2) Warranties and liability regarding the validity of applications

SYMMETRICS and SEASONLY reserve the right to cancel, terminate or modify this operation if it does not proceed as planned: any virus, bug, breach, unauthorised intervention, fraud, action by a competitor, technical problem or other cause beyond the control of SYMMETRICS and SEASONLY that alters or affects the administration, security, fairness, integrity or conduct.

In general, the Participants indemnify the Organisers of this competition against any recourse, action or claim that may be brought by any third party on any grounds whatsoever, in respect of all warranties and commitments made.

Any incomplete or incorrect participation will be rejected, without the Organisers being held liable.

Each participant undertakes to comply with the rules. Any failure by the Participant to comply with the rules, and any fraud, abuse, cheating or false declaration, will result in their exclusion from the competition, without the Organisers being held liable.

Accordingly, the Organising Companies reserve the unrestricted right to moderate retrospectively and not validate, or even exclude or remove from the competition, any participant who fails to comply with one of the conditions of these rules.

Furthermore, in the event of abuse or cheating by one or more participants, SYMMETRICS and SEASONLY reserve the right to modify or terminate the prize draw without notice, particularly where the integrity of the prize draw is compromised in its purpose.

4.3) Prize draw terms

The Winners will be determined by a prize draw held, on the date mentioned above, from the database of registered persons in accordance with the conditions mentioned above.

Article 5 – Prizes

5.1) Commercial value of prizes

Prize 1 is offered by the company SYMMETRICS and therefore constitutes a “prize”. 

The designated prize is as follows: 1 €150 gift voucher to be used on the www.wollnessbetter.shop website and mobile app, valid until 30/06/2023.

– Promotional codes cannot be combined 

Prize 2 is offered by the company SEASONLY and therefore constitutes a “prize”. 

The designated prize is as follows: A one-hour treatment at a Seasonly studio (worth €130), valid until 01/10/2023.

 5.2) Terms for collection, use and renewal

As provided for in Article 6, the Winners must contact SYMMETRICS or SEASONLY directly and comply with the defined terms of use.

The prizes offered may not give rise to any dispute as to their nature or to the provision of compensation of any kind whatsoever.

 

Article 6 – Prize allocation terms

SYMMETRICS will award one (1) prize to one (1) Winner and SEASONLY will award one (1) prize to one (1) Winner. There will therefore be one (1) SYMMETRICS and SEASONLY prize for one (1) natural person.

Once the Winner has been designated by SYMMETRICS and SEASONLY, they will be contacted via the email address used when entering the prize draw.

All email exchanges between the Organiser and the Winner will be retained in the Professional’s email inbox.

The winner will be invited by return email to provide their full contact details (surname, first name, address, town, postcode, telephone number, email address) in order to benefit from the prize won. 

If the information provided by the Participant is incomplete and/or does not enable them to be informed of their prize, they will lose their status as a Winner and will not be able to make any claim.

The Organiser cannot be held liable in the event of technical failures relating to this electronic prize notification. Without communication of this information by the Winner within 10 days, they will lose their status as a Winner.

Where applicable, a second prize draw will take place.

 

Article 7 – Terms of use 

THE BRADERY: Gift vouchers cannot be combined. Gift voucher valid until and including 30/06/2023.

 

Article 8 – Personal and identifying data

By virtue of their participation alone, the Players authorise the Organisers in advance to freely use, for advertising or promotional purposes and in any medium, all personal information provided on their behalf and on all media.

The personal data collected about you is mandatory and necessary for processing your participation in the competition. It is intended for the Organisers, or subcontractors and/or service providers for management purposes.

In accordance with applicable regulations, the information collected is intended exclusively for the Organisers and will not be sold or transferred to third parties in any way whatsoever.

The information provided by the Participant is intended for use by SYMMETRICS and SEASONLY in connection with access to its service in accordance with the general terms and conditions of sale and in connection with the management of this competition.

Any person is deemed to have read, understood and accepted these rules in full and without reservation, in particular the article relating to personal data, as soon as they access and register for the prize draw.

 

Article 9 – Responsibilities and rights

The Organisers:

  • Reserve the right to modify, extend, shorten, limit prizes or cancel this competition in the event of force majeure as defined by case law. Consequently, they cannot be held liable on this basis.
  • Cannot be held liable for fraudulent use of a Participant’s login rights or prize allocation.
  • Disclaim all liability in the event of malfunction of the internet network, telephone lines or receiving equipment preventing the proper running of the competition. Furthermore, they may under no circumstances be held liable for problems with the delivery or loss of electronic or postal mail.
  • Disclaim all liability in the event of any technical, hardware or software failure or anomaly of any kind (virus, bug, etc.) occurring on the Participant’s system, computer equipment and data stored thereon, and for any consequences that may result for their personal, professional or commercial activities.

The Participants:

  • Are responsible for the accuracy of the information provided to the Organisers

 

Article 10 – Exclusion conditions

Participation in the competition implies full and unconditional acceptance of the terms set out in these rules, without any reservation or prior condition on the part of the Participant; failure to comply with these rules will result in exclusion from the competition, the outright invalidity of their participation and of the award of prizes.

 

Article 11 – Filing of the rules

All documents are made available and accessible in French to every user and Participant throughout the duration of the competition. They are requested to make a backup copy and/or print all texts so that they can refer to them if necessary.

 

Article 12 – Participation costs

The competition organised is free and requires no purchase.

 

Article 13 – Competent courts

These rules are governed by French law.

In the event of a dispute or claim concerning the prize draw for any reason whatsoever, requests must be sent in writing to the attention of the company SYMMETRICS or SEASONLY by post to the address mentioned in the preamble, during the prize draw period and no later than sixty (60) days after the Winners are designated.

In the event of a dispute or claim concerning the prize awarded, requests must be sent: 

  • For the attention of Customer Service by email at hello@wollnessbetter.shop within seven (7) days of receiving confirmation of the prize;

 OR 

  • For the attention of SEASONLY by email at wecare@seasonly.fr within seven (7) days of receiving confirmation of the prize. 

 

The parties shall endeavour to resolve amicably any dispute arising from the interpretation or performance of these rules. If the disagreement persists, it shall be submitted to the competent courts.

The Participant acknowledges having read these rules, accepting them without reservation and undertaking to comply with them.
